Congratulations on commencing your creative journey! www.artstash.com.au is fully owned by X-Press Graph-X P/L (ABN 6730 199 576) at 40 Taunton Drive Cheltenham Vic. By using the Art Stash website you are agreeing to the following terms and conditions which combined with the Art Stash privacy policy form the relationship between you and Art Stash.

Art Stash will only deliver to customers with a valid Australian postal address. You must also provide a valid email address and credit card for all orders. Orders can only be placed online.

Your relationship with Art Stash

By placing your order you agree that:

You are legally eligible to enter into a binding contract
You are 18 years or older
You are residing at a recognized Australian postal address
You are solely responsible for all activity and communication conducted through your Art Stash login

You must not use the website for any of the following:

conduct which breaches any laws or regulations
interference with the security of the website,
copying of any content on the website
interference with the server network and host of the website
communication of information, content or material that infringes the rights of a third party including intellectual property rights
communication of false, misleading, offensive or abusive language

Any suspected illegal activity may be referred to the relevant authorities.

When registering your account, you will be required to provide personal information including your name, address, email address and contact phone number which must be current and correct. Your personal information will not be disclosed to any third party without your consent and is governed by our privacy policy, which is contained on our Art Stash Website as a separate document.

When registering with Art Stash you are agreeing to receive emails from Art Stash. However, you are welcome to unsubscribe at any time.

It is your responsibility to keep your login details private and secure. You will be held liable for any unauthorised activity on your account. You must immediately notify Art Stash should you become aware of any unauthorised or illegal use of your account or any other breach of security in relation to your account and must as soon as possible take necessary steps to prevent further such activity including changing your password.

Art Stash may, without prior notice temporarily or permanently limit your access to all or part of the website or revoke your account.

Art Stash reserves the right to amend these terms and conditions, without notice to you. It is your responsibility to review the terms and conditions each time you use the website. Art Stash reserves the right to amend the website, products and services at any time without notice, without liability to you or a third party.

Purchase Options

Art Stash provides the following purchase options:

A single purchase of an individual box
A 3 month subscription of the art box (delivered bi-monthly)
A 3 month subscription of the craft box (delivered bi-monthly)

Art Stash does not provide an ongoing subscription service. Once your 3 month subscription is completed you will need to purchase a new subscription if you wish to continuing receiving your bi monthly art or craft box.

When you purchase a 3 month subscription this cannot be cancelled during the subscription period. You will receive all 3 boxes over a 6 month period.

All products displayed on the website do not constitute an offer to sell, and are an invitation to treat only.

Please check your order carefully. Once an order is confirmed and paid for, you will not be able to cancel or amend your order.

Delivery & Title

Delivery is strictly limited to Australia postal addresses only.
Delivery times will vary depending on where you are located. Please allow up to 2 weeks from the next launch date. If you order your box on the 17th, you will guarantee yourself a box however we wait until the cut off date to send all boxes, so you may be waiting a while. We will notify you of dispatch. If you want a box quickly, you can order last months box which will be shipped out within 2 working days.
We assume that you may not be home when your goods are delivered so we have pre selected that the goods can be left at your delivery address. If however, you would prefer to sign for the goods please ensure you tick this selection in which case you must be home when the goods are delivered of the goods will be returned to your nearest post office for your collection.
Art Stash may require the person accepting the delivery of the products to provide us with proof of that person's identity.
Your box from Art Stash will be delivered using a third party carrier. In placing your order, you accept that title in and risk to the box will pass to you upon the third party carrier being given possession of the box by Art Stash.
Art Stash does not accept liability or responsibility for incorrectly placed orders.
Art Stash does not accept liability or responsibility for delivery details which are incorrectly supplied.

Acceptance or Rejection of an order

Art Stash reserves the right to accept or reject an order for any reason including but not limited to the quantity, availability of a certain product or an error in the price of description of the product.

If your order is rejected you will be notified by email within 14 days of submitting your order.

You are not permitted to purchase any items for resale to a third party or for trade purposes. If we are concerned with the quantity of item/s you have ordered, we will endeavour to contact you within 14 days of submitting your order.

Return Policy

Art Stash does not accept returns of boxes or individual products unless the following applies:

If you consider that the product provided is defective or fails to comply with the Statutory Guarantee provided pursuant to Australian Consumer Law, you may be required to provide a photograph or to return the product for examination by Art Stash. Art Stash will assess the alleged defective product and will notify you of the outcome via email within 14 days. Art Stash reserves the right to refund or replace the product.

If you receive a box or product which arrives damaged you must send through a photograph of the damaged item to Art Stash as soon as possible once you have opened the box. Any requests for a replacement box or product must be made within 2 weeks of receipt of your delivery. Art Stash reserves the right to assess the damage and may replace the box or products at its discretion. Art Stash will not replace or refund any used or open products. In the event that a damaged or faulty product is sold out, Art Stash may provide you with an alternative product, which may or may not be of equal value.

Refunds will not be provided if you have incorrectly entered your delivery address.

Price

The price of the products and delivery fees are displayed on the website and may be amended at any time without notice.

Product prices and delivery charges include GST.

Payment

Payment for all products must be by credit card.

Orders will be charged to your nominated payment method.

You must ensure that your payment method details are valid and up to date. The following forms of payment are acceptable:

Visa, MasterCard and American Express.

Please ensure that sufficient funds are available when processing your payment.

Art Stash does not collect or store payment information. All payment information is collected and stored by the applicable third-party in order to be processed as required.

All online credit card transactions are through a secured payment gateway. We currently use the Stripe for our online payment transactions.

Full credit card details cannot be viewed by Art Stash.

Payments will appear on your bank statement as “Art Stash Australia”

Failed Payments

Payment failures may occur due to insufficient funds, incorrect payment information, and transaction disputes.

If payment fails, we will contact you by email to inform you.

Goods will not be shipped until payment is processed.

Disclaimer and Limitation of Liability

All content on the website is to the best of our knowledge intended to be accurate and complete. However, Art Stash does not make any representations or guarantees as to the accuracy, completeness or reliability of any information on the website. Information may contain errors or inaccuracies and you must make your own enquiries to verify the product information provided. Art Stash excludes any liability that may arise in relation to the accuracy, completeness or reliability of any information on the website. Art Stash reserves the right to correct any information without any liability to you or a third party.

All information on the website is of a general nature and is professional advice. Art Stash does not make any representations or guarantees as to the suitability of the products on the website for any specific requirements. It is your responsibility to assess the suitability of all products prior to you using them.

The promotional and marketing material on the website is not necessarily an exact representation of what is in the monthly box. The products on the website may differ in combination, size, colour, appearance and packaging to the products included the box.

Despite our best efforts we do not guarantee that the website will be available at all times or that there will be uninterrupted access, nor delays, failures, errors or omissions or loss of transmitted information. Nor do we warrant that there will be no viruses or other contaminating or destructive properties transmitted, or that no damage will occur to your computer system.

It is your responsibility to take the necessary precautions to ensure that the process which you use to access the website do not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your computer system or any other computer system.

We do our best to protect your information but we do not warrant the security of any information which you transmit to us. Any information which you transmit to us is transmitted at your own risk.

replacement or resupply of the products; or
the cost of replacing or resupplying the products and will not exceed the fees paid by you to us in relation to your order.

We will not under any circumstances be liable for any loss of profit, loss of revenue, loss of contract, loss of business opportunity, loss of reputation, loss of data or any indirect or consequential loss arising in connection with our terms and conditions or the products provided.

The web site may contain links to other 3rd party web sites which are not maintained or endorsed by Art Stash.

Any reference to 3rd party web sites should not be taken as an endorsement, approval or recommendation by us of those web sites, or of any information, images materials, products or services referred to or contained on those web sites unless otherwise specified.

We do not accept any responsibility or liability in respect of any of 3rd party websites which may be linked to Art Stash.

These terms and conditions are binding and enforceable on you and on Art Stash and our respective successors and assignees.

You must not transfer, assign, charge or otherwise dispose of your rights or liabilities under these terms and conditions, or any of your rights or obligations arising under them, without our prior written consent.

Art Stash may transfer, assign, charge, sub-contract or otherwise dispose of any of our rights or obligations arising under these terms and conditions, at any time without your prior consent.

Intellectual Property

Art Stash is the owner or licensee of all intellectual property rights in the web site, whether registered or unregistered. All works contained on the web site are protected by copyright laws and all such rights are reserved.

You may print off one copy, and may download extracts, of any pages from the web site for your personal reference. You must not use any part of our copyright materials for commercial purposes without first obtaining a licence to do so from us.

Any comments regarding the products or services provide by Art Stash posted to any website, blog or social media network must represent your fair and honest opinion and cannot be vivacious.

Agreeing to these terms and conditions, irrevocably authorises Art Stash to quote any comments you may leave on the At Stash web site or associated linked web sites.

Force Majeure

Art Stash will not be liable or responsible for any failure to perform, or cause delay in performance of, any of our obligations under these terms and conditions, which are caused by a force majeure event, which is beyond our control.

A force majeure event includes any act, event, omission or accident beyond our reasonable control and includes (but is not limited to) the following:

strikes, lock-outs or other industrial action;
riot, invasion, terrorist attack or threat of terrorist attack, war or preparation for war;
fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
inability to use of railways, shipping, aircraft, motor transport or other means of public or private transport;
inability to use public or private telecommunications networks;
epidemic, pandemic or other health emergency (declared or not); and
acts, decrees, legislation, regulations or restrictions of any government.

The performance of Art Stash under these terms and conditions is deemed to be suspended for the period that the force majeure event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under these Terms and Conditions may be performed despite the Force Majeure Event.
